GigaPan E-Commerce Store Terms and Conditions

GigaPan Systems, LLC (“GigaPan”) has created this website (“Site”) to provide an online platform for high-resolution panoramic photography for members, users, and fans.  This Site is operated by Gigapan.  All of the rights associated with this Site and its content is the exclusive property of GigaPan and GigaPan’s relationship with third party photographers.  You agree to indemnify, defend and hold harmless GigaPan, our officers, directors and employees, including its agents, suppliers, third party photographers, partners, franchisees and subsidiary companies, from and against any liabilities, costs, damages, claims, judgments or expenses (including reasonable attorney fees) that result from your unauthorized use of the content included on this Site or from any violation of these terms and conditions or your use of the images provided.

You assume sole responsibility for all consequences of your use of this Site and agree that GigaPan will not be liable for damages of any kind arising from your use of (or inability to use) this Site including, but not limited to, direct, indirect, punitive or consequential damages.

By accessing, using and purchasing from this Site you agree to be bound by these Terms and Conditions and to any additional guidelines, restrictions or rules that may be posted in connection with specific sections or services of this Site. You agree that we may provide all legal communications and notices to you electronically by posting them on our website or, at our election, by sending an e-mail to the e-mail address you have provided us. All such additional posted guidelines, restrictions or rules are hereby incorporated by reference into these Terms and Conditions.  GigaPan reserves the right to make changes to this Site and to these Terms and Conditions at any time without prior notice. You should review these Terms of Use each time you access this Site.

GigaPan Photographers and/or Registered Members own and retain the copyrights to the images.  GigaPan is committed to protecting the photographers’ copyrights.  The images on our Site are copyrighted and protected under U.S. and international Copyright Laws. All rights reserved. You are purchasing a print of a photo or image only, not the right to use or reproduce the photo. To copy, scan, reproduce, republish, upload, post, transmit, distribute or publicly display any image outside of the context of a specific purchase you will need written permission from GigaPan and the photographer.

"GigaPan Systems, LLC", “GigaPan” and the "GigaPan Systems" logo are trademarks. All other trademarks and logos used in this website are the trademarks or logos of their respective owners.

This Site may provide links to other websites which are not operated by GigaPan.  GigaPan assumes no responsibility for any aspect of the operation of those other websites or for the content included on those websites. You specifically waive any claim that you may have against GigaPan with regard to the inclusion of such links on the GigaPan Site, the content displayed on such linked websites or the policies and operations of such linked websites.

Image quality is inherently subjective and GigaPan is not responsible for any originating image quality issue. GigaPan will fulfill the image print order as it exists on our Site, however is not responsible for any quality issue, error or omission.

GigaPan does not guarantee that access to this Site will be uninterrupted, that this Site will be free from viruses or that this Site cannot be tampered with by third parties. This Site and the information are provided on an 'as is' basis, with no warranties of any kind whatsoever, either express or implied, including, but not limited to, any warranties or any implied warranties of merchantability or fitness for a particular purpose. Use of this Site and the information is entirely at the user's sole risk. In no event will GigaPan be liable for any damages whatsoever arising out of or related to this Site. Your sole and exclusive remedy for dissatisfaction with this Site and/or information is to stop using the Site and the information.

When you create an account or order a print from GigaPan, you are required to provide some personal information.  We protect and use this information as set in our Privacy Policy.

We reserve the right to change these Terms and Conditions, prices and information on this Site without notice. These conditions set out the entire agreement between GigaPan and you relating to your use or print purchase of the images, our hardware and our software.  Any changes will apply prospectively from the date the change is made on this website.  Your continued use of this Site following such notification of any such revision(s) shall be deemed as acceptance of and agreement to abide by all such revisions.

These purchase terms comprise a binding contract between you as a user of the GigaPan Site for the purchase of photographic prints made from digital files supplied by participating third-party photographers and panoramic camera hardware, accessories and software licenses (“Products”).
These purchase terms form a binding contract between you and GigaPan for the purchase and supply of the Products when the following conditions have been met:

You have submitted an order to buy certain Products using the order facility provided; and

GigaPan notifies you by e-mail that your order for Products has been accepted and GigaPan agrees to supply the Products to you.

All Products will be delivered to you at the shipping address provided, within the service time-frame specified of your order being accepted by GigaPan, as noted above above, unless an alternative timeframe is notified to you by GigaPan, prior to the expiry of a 4-working day period.
The time of delivery is an estimate only and GigaPan shall not be liable for any late delivery of the Products or any consequential loss or damage caused as a result.

The customer agrees that the shipping terms for all Products are FOB shipping point and ownership transfers to the customer upon shipment. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.


Prints & Software
Prints and software are provided to the recipient as is.  No returns are accepted.  Items will be delivered as ordered.  If an item is damaged, we will accept a return for an exchange, provided the item is returned within seven (7) days from receipt date of the shipment. Personalized photos may not be returned unless they are damaged.

If you are not satisfied with your GigaPan Epic product, you can request a return within 30 days from the date of your purchase.

Conditions: Products must be in sellable, like new condition and include all original materials. All products will be inspected and tested before being accepted. The customer is responsible for the cost of shipping the item back to GigaPan Systems. Since we can often troubleshoot and fix problems over email or the phone for free, all refunds must be approved by GigaPan before being received in our return facility.

Non-Refundable Products: The cost of shipping cannot be recovered from shipping providers and is not refundable. Software and some accessories cannot be resold are not eligible for returns or refunds.

Receiving Your Refund: Once your returned product is received, inspected and approved, any refund amount will be processed to the credit card used in the original purchase within 5 business days. It often takes credit card issuers 3-5 additional business days to post the money to your account.

The item should be taken to your local packaging store to assure proper mailing procedures. Please be certain to include the following information:

Item being returned
Telephone Number
GigaPan Print Order Number

Once your Product is received, inspected and approved, we will issue an exchange order within 10 business days. Shipping and handling charges will not be refunded.  You will be notified of your order progress by email.

We want to make sure you are completely satisfied, so if there is a problem with your order, please contact us within seven (7) days.
